AppInspected

Terms of Service

Draft for legal review. Not yet in effect. Effective date to be set.

These terms are an agreement between you and 1520840 B.C. Ltd., a British Columbia company ("we", "us"), which operates AppInspected (the "Service"). By using the Service you agree to these terms. If you use it for an organization, you confirm you can bind that organization to them.

1. What the Service does

The free quick check reads information that is publicly available from a web address you submit: the page, its same-site JavaScript files, its response headers, and a small number of well-known file paths. Paid reports, when offered, go further, for example by testing database access rules from outside your app or by reading your code with access you grant.

2. Best-effort results, no guarantee

The Service is an automated, best-effort check for a limited set of common problems. It is not a penetration test, a security audit, or a certification. It can miss vulnerabilities, and it can report issues that turn out not to be problems. A clean result means only that the specific checks we ran did not detect an issue at that moment. You remain responsible for the security of your applications, data and users.

To the fullest extent permitted by law, the Service and all results are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

3. Apps you may check

You may use the free quick check only on addresses that are publicly reachable. You may request a paid report only for an application that you own or are expressly authorized to test, and you must complete the ownership check we require before it runs. You must not use the Service, or any result from it, to access, attack, disrupt, or exploit any system or data that you are not authorized to access.

4. Acceptable use

You must not: overload or interfere with the Service; bypass rate limits or access controls; use the Service to break any law; resell the Service without our written permission; or attempt to use any credential the Service reports. Automated use by software agents is allowed through the documented API, within its published limits.

5. The badge

If you subscribe to monitoring, we grant you a limited, revocable, non-transferable licence to display the AppInspected badge on the application covered by your subscription. The badge and its status page reflect only the result of our most recent automated check. They are not a certification or endorsement of your application. We may change the badge's status or remove it if a check fails, your subscription ends, or you breach these terms. You must not alter the badge or display it on any other application.

6. Payments and refunds

Prices are shown before you buy. One-time reports are charged when ordered. Subscriptions renew automatically each billing period until cancelled, and cancellation takes effect at the end of the current period. If a paid report cannot be completed for a reason within our control, we will refund it. [Refund policy details to be confirmed before paid plans launch.]

7. Your data

How we handle information is described in our Privacy Policy. Code and data accessed for a paid report are used only to produce that report and are deleted within 7 days after the report is delivered.

8. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data, or goodwill, including losses arising from a security incident affecting your application, whether or not the Service detected the underlying issue. Our total liability for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim arose, or CAD $100.

9. Indemnity

You will indemnify and hold us harmless from claims, losses and costs (including reasonable legal fees) arising from your use of the Service in breach of these terms, including any check you requested on a system you were not authorized to test.

10. Changes and ending the Service

We may change these terms by posting an updated version and, for paying customers, notifying them by email at least 14 days before material changes take effect. We may suspend or end access for anyone who breaches these terms. You may stop using the Service at any time.

11. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there. The courts of British Columbia have exclusive jurisdiction over any dispute, except where the law of your place of residence gives you a non-waivable right to bring a claim elsewhere.
